Job purpose

Job Purpose:

Working autonomously, this role is responsible for undertaking investigations in relation to disciplinary and employee led complaints/grievances (ELC) cases, making recommendations and presenting the findings to an independent panel and at Employment Tribunal if necessary.

Working closely with and supporting the ER Lead to investigate highly complex disciplinary cases and ELC's.

Supporting chairs at formal hearings, presenting at hearings and supporting managers in formal meetings.

Providing timely advice and support to the Trust in respect of ER case management.

Giving professional ER advice and promoting good practice in all aspects of Trust HR Policies and Procedures across the Trust at an operational level, advising and supporting managers in the areas of conduct and capability issues, Employee Led Complaints (grievances), Raising Concerns (whistleblowing), absence management and employment law.

Working with the ER Lead and ER Manager in coaching and supporting managers on a range of ER matters.

Assisting the ER Leads and ER Manager in developing and delivering the provision of a centre of excellence in the area of ER.

Main Duties and Responsibilities
  1. Ensure that disciplinary, employee led complaints (ELC's), performance management (including probation) and sickness absence cases are progressed in accordance with Trust policy and good practice.
  2. Review paperwork for each case to determine whether appropriate to proceed to a formal stage and, in respect of disciplinary and ELC's, establish agreed terms of reference and scope of investigation.
  3. Evaluate information received during an investigation and/or review report findings to determine fairness and robustness or whether there is a need for additional evidence before determining whether to proceed to a formal hearing.
  4. Where cases are referred to a panel, present the investigation findings to an independent panel, supporting witnesses attendance where required.
  5. Support managers where they need to present report findings to an independent panel i.e. performance management and sickness absence.
  6. Provide ER advice and support to the chair of an independent panel for disciplinary, sickness and probationary cases ensuring that the hearings are conducted in line with Trust policies and Employment Law.
  7. Develop strategies for the management of cases in collaboration with ER colleagues, line managers and lawyers.
  8. Communicate with partners and external agencies such as trade unions and Trust lawyers.
  9. Represent the Trust at Employment Tribunals, if necessary.
  10. Coach and mentor members of the ER Team.
  11. Keeping accurate records of cases.
  12. Provide cover for other investigation colleagues, as required.
  13. Achieve performance outcomes as required within the Team.
Qualifications

Requirements:

  • To hold or be committed to working towards CIPD qualification or equivalent
  • Demonstrable ability to write clear and concise report
  • Demonstrable ability to analyse and interpret data
  • Knowledge, understanding and application of equal opportunities
  • Demonstrable experience human resource experience with a track record of success
  • Experience of dealing with a range of employee relations matters
  • Ability to work on own initiatives
  • Able to prioritise work and meet deadlines
  • Demonstrable experience supporting change management exercise
  • Experience in working effectively with staff side
