Job Description
About the Job Union Public Service Commission is hiring an Additional Legal Adviser at Ministry of Law and Justice. Eligibility A. Educational QualificationA Degree in Law from a recognized University or an equivalent qualification.B. ExperienceThe candidate should satisfy any one of the following conditions:
  • He should have been a member of a State Judicial Service for a period of not less than thirteen years; or
  • He should have held a superior post in the Legal Department of a State for a period of not less than thirteen years; or
  • He should be a Central Government servant with not less than thirteen years of experience in legal affairs; or
  • He should be a qualified legal practitioner.
NotesI)Qualified legal practitioner-For appointment to a duty post in Grade II by direct recruitment, this means:
  • An advocate or a pleader who has practiced for at least thirteen years; or
  • An attorney of the High Court of Bombay or Calcutta who has practiced as such attorney and as an advocate for a total period of at least eleven years.
II)Superior postin the Legal Department of a State means a post in the State Government that is not clerical in nature and requires a Degree in Law as a qualification for appointment.III) In computing the period during which a person has held any office in the State Judicial Service, in the Legal Department of a State, or under the Central Government, any period during which he has held any of the other aforesaid offices or has been a legal practitioner shall also be included.IV) In computing the period during which a person has been a qualified legal practitioner, any period during which he has held office in the State Judicial Service, held a superior post in the Legal Department of a State, or served as a Central Government servant with experience in legal affairs shall be included.V)Legal affairs-The term is broad and may be construed to include the following:a) Rendering legal advice on all matters, including conveyancing;b) Conducting court cases and appearing in courts as a Government Pleader or Public Prosecutor.Note: Mere drafting of pleadings without substantive legal input shall not qualify as conduct of court cases.Although the termlegal affairsdoes not have a statutory definition, it encompasses all matters relating to law and the conduct of litigation in courts or quasi-judicial forums. For recruitment to posts in legal affairs in the Central Government, a Law degree is a prerequisite and essential qualification, in addition to post-qualification experience. Experience in legal affairs in the Central Government shall be construed as the discharge of legal duties requiring an LL.B. degree.VI)Post-qualification experienceshall be reckoned with reference to the minimum prescribed qualification.
  • If the minimum qualification is LL.B., only post-LL.B. experience will be considered.
  • If the minimum qualification is LL.M., only post-LL.M. experience will be considered.
Responsibilities
  • to give advice on all matters referred by the various Ministries/Departments of the Government of India.
  • to look after Government litigation work.
  • to conduct court cases and to appear in courts on behalf of the Central Government, wherever required and
  • to perform administrative and other works as may be assigned.
Location New Delhi/Mumbai/Kolkata/Chennai/Bengaluru. Liable to serve anywhere in India. Pay Scale As per the 7th CPC, Level-13 ( 1,18,500- 2,14,100) in the Pay Matrix, the total emoluments at the time of initial appointment will be 1,18,500 plus Dearness Allowance (DA) as applicable per month, excluding HRA and TA.
